TERMS AND CONDITIONS

Electron & Oddities

These Terms and Conditions (“Terms”) apply to all services and products provided by Electron & Oddities (“we”, “us”, “our”), operated as a sole trader business in Australia. By engaging our services, submitting a device, or purchasing goods or services from us, you agree to these Terms.

 

1.       SERVICES PROVIDED

Electron & Oddities provides, but is not limited to, the following services:

• Computer and electronic device repair

• Hardware upgrades and component replacement

• Custom system builds and configurations

• Diagnostics, maintenance, and internal cleaning

• Call-out (on-site) services

• Mail-in repair services

• Drop-off and collection services

• Basic 3D printing services using customer-supplied files

Services are provided subject to device condition, availability of parts, and technical feasibility.


2.       DIAGNOSTIC FEE

A diagnostic fee may apply to all devices submitted for inspection, troubleshooting, or assessment.

The diagnostic service includes:

• Initial fault assessment

• Functional testing where possible

• Basic internal and/or external cleaning as required to safely inspect the device

The diagnostic fee is payable regardless of whether repairs proceed.

Diagnostic fees are non-refundable, as time, labour, and resources are expended during assessment.

If you approve quoted repairs, the diagnostic fee may be credited toward the final repair cost, where stated at the time of quoting.


3.       QUOTES AND ESTIMATES

All quotes are estimates only unless stated otherwise in writing.

Additional faults or issues discovered during service may result in revised pricing.

Reasonable efforts will be made to obtain customer approval before proceeding with additional work.


4.       PAYMENT TERMS

Payment may be required before or upon completion of services unless otherwise agreed in writing.

For mail-in services, payment must be received before return shipping.

For call-out services, payment is due at the conclusion of the appointment.

Devices may be withheld until full payment is received.

Invoices not paid by the due date may be subject to recovery action, including referral to a debt collection agency or legal proceedings. The customer may be liable for reasonable recovery costs, interest, and fees where permitted by law.


5.       CALL-OUT SERVICES

Call-out fees may apply depending on distance, time, or urgency.

Appointment times are estimates only and may be affected by traffic, complexity of work, or unforeseen delays.

Customers must provide safe, reasonable access to the premises and equipment.


6.       MAIL-IN REPAIRS

Customers are responsible for securely packaging devices sent to us.

Electron & Oddities is not responsible for damage occurring during shipping to us.

Return shipping costs are the customer’s responsibility unless otherwise agreed.


7.       DROP-OFF REPAIRS AND UNCOLLECTED ITEMS

Devices must be collected within 30 days of service completion or notification.

Storage fees may apply to uncollected devices.

Devices left uncollected for 90 days or more may be disposed of or sold to recover costs, where permitted by law.


8.       PRE-EXISTING DAMAGE AND CORROSION

Devices submitted for service may already contain pre-existing faults, damage, corrosion, liquid ingress, dust buildup, wear, or component degradation, whether visible or hidden.

You acknowledge that diagnostics, cleaning, power-up, testing, or repair may cause latent faults to surface or worsen, including total device failure.

Electron & Oddities is not responsible for the progression or discovery of pre-existing damage, including corrosion-related failure, brittle plastics, failing solder joints, or weakened components.

No guarantee is made that a device will remain operational following inspection or repair where pre-existing damage exists.


9.       DATA, BACKUPS, AND DATA LOSS

Customers are strongly advised to back up all data before submitting any device.

While reasonable care is taken, data loss, corruption, or access issues may occur during diagnostics, repair, or upgrades.

Data recovery services, where offered, are not guaranteed.


10.    LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Electron & Oddities is not liable for any indirect, incidental, or consequential loss or damage, including but not limited to loss of data, downtime, loss of income, loss of business, or loss of use of equipment.

Our total liability for any claim relating to goods or services supplied is limited to the repair, replacement, or refund of the goods or services, as required under the Australian Consumer Law (ACL).

Customers are solely responsible for backing up all data before submitting any device for diagnostics, repair, servicing, upgrade, or inspection.

Nothing in these Terms excludes, restricts, or modifies any rights or guarantees provided under the Australian Consumer Law.


11.    PARTS, WARRANTIES, AND CUSTOMER-SUPPLIED COMPONENTS

New parts supplied by Electron & Oddities may be covered by a manufacturer’s warranty only.

Labour warranties, if offered, apply only to the specific work performed.

No warranty is provided on customer-supplied parts, files, or materials unless required by law.

Testing and troubleshooting of customer-supplied components may be billable.


12.    3D PRINTING SERVICES

Electron & Oddities provides basic file-to-print services only.

Customers are responsible for ensuring they own or have permission to print submitted files.

We do not guarantee design accuracy, strength, fitness for purpose, or dimensional perfection beyond normal printing tolerances.

All prints are provided as-is once completed and inspected.


13.    ABANDONED DEVICES AND DATA

Devices left uncollected beyond the timeframes stated in these Terms are considered abandoned.

Once a device is deemed abandoned, Electron & Oddities may dispose of, recycle, or sell the device to recover costs, where legally permitted.

Any data remaining on abandoned devices may be inaccessible, erased, or destroyed during lawful disposal.

Electron & Oddities accepts no responsibility for data retention, recovery, or confidentiality on abandoned devices beyond reasonable care prior to disposal.


14.    REFUSAL OF SERVICE

Electron & Oddities reserves the right to refuse, suspend, or discontinue service if:

• A device poses a safety risk

• Illegal material is discovered

• Payment terms are not met

• A customer behaves abusively, threateningly, or unreasonably


15.    ILLEGAL MATERIALS OR EVIDENCE FOUND DURING SERVICE

If, during diagnostics, repair, servicing, 3D printing services, or any other work, Electron & Oddities reasonably discovers materials or data suspected to constitute illegal activity under Queensland or Australian law, Electron & Oddities may:

a) Immediately cease all work on the device

b) Secure and retain the device and any relevant storage media

c) Provide the device, data, and identifying information to Queensland Police or another lawful authority

Personal information will only be disclosed where required or permitted by law.

By submitting a device for service, you authorise Electron & Oddities to comply with lawful requests from authorities.

Electron & Oddities accepts no liability for loss, damage, or delays arising from lawful seizure or disclosure made in good faith.

Electron & Oddities may be legally prohibited from informing you if a device or data has been seized as evidence.


16.    FORCE MAJEURE / EVENTS BEYOND OUR CONTROL

Electron & Oddities is not liable for failure or delay caused by events beyond reasonable control, including but not limited to:

• Power outages

• Internet or network failures

• Natural disasters

• Theft or vandalism beyond reasonable precautions

• Supplier or courier delays

• Government actions or restrictions

Service timelines may be extended where such events occur.


17.    PRIVACY

Personal information is collected solely for providing services, communication, billing, and legal compliance.

We do not sell personal data and only disclose information where required or permitted by law.


18.    AUSTRALIAN CONSUMER LAW

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a repair, replacement, or refund for major failures and compensation for other reasonably foreseeable loss or damage.


19.    GOVERNING LAW

These Terms are governed by the laws of Australia, with jurisdiction in Queensland, unless otherwise required by law.
